The User may approach Riverside at any time should it be necessary to correct, block or delete the data stored relating to his person. Additionally, Riverside shall at any time provide information as to which data relating to the User have been stored as well as to the source and recipients thereof and the purpose of the storage. We may, at our own discretion, require proof of identity to process your applications.

1 Collection and Usage of Personal Data

1.1 It is possible for any User to use our Website without registration.

1.2 Each time a User accesses the Website and whenever a file is retrieved, access data pursuant to these occurrences shall be stored on our server. These are:

1.3 Beyond that, Riverside, as a fundamental rule, only collects and uses personal data which the User transmits upon using the Website, for example when booking a room or an event or meeting inquiry via the contact form on the Website. Personal data of the User shall be collected, used and stored for the processing of a contract. “Personal Data” are such data that contain information pursuant to your personal or material circumstances (e.g. name, address, date of birth, e-mail address, bank details or credit card data).

1.4 Data processing for bookings

1.4.1 Bookings on our website
When making a inquiry and/or a booking online or by telephone your full name and address, e-mail address and the arrival and departure dates - if required - must be quoted. These data are necessary tor the processing of the booking. Beyond that, further details may be necessary, such as your telephone number, company, event date, number of plenary, number of people, bank details or credit card data.

We use this data, which you must provide when making a booking via our website (mandatory field), to establish your identity before concluding the contract. We need your e-mail address to confirm your booking and for future communication with you that is necessary to process the contract. We store your data together with the marginal data of the order (e.g. designation, price and characteristics of the ordered products), the data for payment (e.g. selected payment method, confirmation of payment) as well as the details for the processing and fulfilment of the contract, so that we can ensure correct order processing and fulfilment of the contract. The legal basis for this data processing is the fulfilment of a contract with you according to Art. 6 para. 1 lit. b DSGVO.

For booking processing via our website, we use a software application from Rebag Data AG, Einsiedlerstrasse 533, 8810 Horgen (Protel booking system). Therefore, your data may be stored in a Rebag Data AG database, which may allow Rebag Data AG to access your data if this is necessary for the provision of the software and for support in the use of the software.

1.4.2 Bookings on booking platforms
If you make bookings via a third-party platform (f.e. via Booking, Hotel, Expedia, Holidaycheck, Tripadvisor, Trivago etc.), we receive various personal data from the respective platform operator in connection with the booking made. This is usually the data listed of this data protection declaration. In addition, enquiries about your booking may be forwarded to us. We will process this data by name in order to record your booking as requested and to provide the booked services.  The legal basis of the data processing for this purpose is the implementation of pre-contractual measures and the fulfilment of a contract according to Art. 6 para. 1 lit. b DSGVO.

1.4.3 Table reservation
On our website you have the possibility to reserve a table in a restaurant mentioned on our website. For this purpose, we collect - depending on the respective offer - data such as name, e-mail address as well as telephone number and the reservation date.

We collect and process the data to process the reservation, in particular to make your reservation request in accordance with your wishes and to contact you in the event of any uncertainties or problems. We store your data together with the marginal data of the reservation (e.g. date and time of receipt, etc.), the data on the reservation (e.g. assigned table) as well as information on the processing and fulfilment of the contract so that we can ensure correct reservation processing and contract fulfilment. We use a Lunchgate AG software application to process table reservations, which may allow Lunchgate AG to access your data if this is necessary to provide the software and to support you in using the software. The legal basis for this data processing is the fulfilment of a contract with you in accordance with Art. 6 para. 1 lit. b DSGVO.

1.4.4 Orders via our online voucher shop
On our website you have the possibility to order tickets and vouchers. For this purpose, we collect - depending on the respective offer - data such as name, e-mail address, address, telephone number and, in the case of tickets, the event date as well as credit card details (see also point 1.6). We use the software application E-Guma Gutschein- und Ticketingsystem Idea Creation GmbH to process the booking.

We use the data to establish your identity before concluding a contract. We need your e-mail address to confirm your order and for future communication with you - which is necessary to process the contract. We store your data together with the marginal data of the order (e.g. designation, price and characteristics of the ordered products), the data for payment (e.g. selected payment method, confirmation of payment and time) as well as the details for the processing and fulfilment of the contract so that we can ensure correct order processing and contract fulfilment.

1.5 Payment processing in the hotel
When you purchase products, obtain services or pay for your stay in our hotel using electronic means of payment, the processing of personal data is required. By using the payment terminals, you transmit the information stored in your means of payment, such as the name of the cardholder and the card number, to the payment service providers involved (e.g. payment solution providers, credit card issuers and credit card acquirers). They also receive the information that the payment method was used in our hotel, the amount and the time of the transaction. Conversely, we only receive the credit note for the amount of the payment made at the relevant time, which we can assign to the relevant voucher number, or information that the transaction was not possible or was cancelled. Please also always note the information provided by the respective company, in particular the data protection declaration and the general terms and conditions.

1.6 Online payment processing
When you make chargeable bookings on our website or order services or products, depending on the product or service and the desired method of payment, you may be required to provide additional data, such as your credit card information or login to your payment service provider. This information, as well as the fact that you have purchased a service from us for the amount and at the time in question, is forwarded to the respective payment service providers (e.g. payment solution providers, credit card issuers and credit card acquirers). In doing so, please always also observe the information of the respective company, in particular the data protection declaration and the general terms and conditions. The legal basis for our data processing is the fulfilment of a contract according to Art. 6 para. 1 lit. b DSGVO

1.7 Persons under 18 years of age should not transmit any personal data to us without the consent of their parents or legal guardian. We do not demand any personal data from children and youths; and we neither collect nor pass on to third parties any such data.

1.8 The personal data shall be treated as confidential, thereby taking the regulations of the statutory data protection laws into consideration. The data shall not be passed on to third parties without the permission of the User unless this should be necessary for the implementation of the orders, the payment transaction or for the processing of inquiries, or be permissible under statutory regulations. Further particulars pursuant to the forwarding of data to third parties may be found in Section 5 “Forwarding of Personal Data to Third Parties”.

1.9 Data processing for the fulfilment of legal reporting obligations
Upon arrival at our hotel, we may require the following information from you: Name, first name, address, e-mail address. We collect this information for the fulfilment of legal reporting obligations, which arise in particular from the hospitality industry or police law. Insofar as we are obliged to do so under the applicable regulations, we forward this information to the competent authority. The legal basis for processing this data lies in our legitimate interest within the meaning of Art. 6 (1) lit. c DSGVO in complying with our legal obligations.

2 E-Mail Newsletter

2.1 Consent

Upon registering for the newsletter the User consents to being sent a newsletter regularly by e-mail containing information pursuant to any Riverside innovations, promotion campaigns and offers (as well as articles on the themes of meetings, events and weddings). The personal data that Riverside processes for the dispatching of the newsletter shall be forwarded to third parties inasmuch as this should be necessary for the dispatching of the newsletter or permissible under statutory regulations. This consent to use of the e-mail address may be revoked at any time with effect for the future (datenschutz@riverside.ch). Additionally there is the possibility of cancelling further delivery of the newsletter via a separate link directly at the end of every newsletter.

2.2 Existing Customers

Inasmuch as a User should have registered with Riverside via the Website and/or have booked hotel rooms in this manner, he shall, as a so-called existing customer, automatically receive an e-mail containing an evaluation questionnaire subsequent to a stay in the Riverside hotel as well as our regular newsletter concerning Riverside innovations, promotion campaigns and offers.

The User may object to the usage of his e-mail address for the sending of the evaluation e-mail and the newsletter at any time with effect for the future. To this end there is the possibility of de-registering via a separate link directly at the end of every newsletter or by sending an e-mail to datenschutz@riverside.ch .

 

3 Riverside SMS

By registering for Riverside SMS, the user has agreed to receive irregularly by SMS information about news, special offers and offers from Riverside (as well as articles about meetings, events and weddings). The data (mobile phone number) that Riverside processes for sending the SMS will be passed on to third parties insofar as this is necessary for sending the SMS or permitted by law. 4 Processing and Deletion

4.1 Riverside, either on its own initiative or in response to the wish of the User, complete, correct or delete any incomplete, erroneous or out-of-date data that have been stored by Riverside in connection with the operation of this Website.

4.2 Riverside shall, at the instigation of the authorised party, delete any personal data within the framework of the statutory regulations inasmuch as no mandatory statutory archiving obligations should stand in the way thereof. We may, at our own discretion, require proof of identity to process your applications.

 

5 Forwarding of Personal Data to Third Parties

5.1 The personal data of the User shall be treated confidentially and, as a fundamental rule, only be forwarded to external service companies inasmuch as this should be necessary for the fulfilment of the contract and processing of inquiries. The external service companies are under an obligation to treat said data in a confidential and safe manner and may only utilise the data should this be necessary for the fulfilment of their obligations.

5.2 This particularly applies to any payment transactions handled by external service companies and to the exchange of data for information on creditworthiness in the context of a review of credit rating in the event of a legitimate interest or of conduct not in accordance with the terms of the contract. The protection-worthy concerns of the User shall be taken into account according to statutory regulations.

5.3 Furthermore personal data shall only be forwarded inasmuch as the User should previously have granted his explicit consent or should this be necessary for the prosecution of criminal offences. The transmission to official bodies or state institutions entitled to receive information shall only be effected in the event of a statutory obligation to provide information or should a court ruling have ordered this. Your protection-worthy concerns shall be taken into account within the framework of statutory data protection regulations. It may be the case that we, owing to statutory obligations, might be obliged to disclose your data to third parties. We shall comply with any such demands, inasmuch as this should be necessary, only within the framework of our statutory obligation.

5.4 Any declaration of consent you may have granted to the forwarding of the data may be revoked at any time and without stating any reasons.

 

6 Protection of the Data

The protection of personal data is an important corporate principle at Riverside. This is achieved, inter alia, by way of training sessions, a data protection officer and the subjection of external service companies to an obligation to data secrecy and adherence to restrictions under data protection laws.

All technical und organisational, physical and logical facilitates and actions in the fields of data protection, IT and information security serve the purpose of affording protection against the damaging, destruction and unauthorised accessing of the stored data and the achieving of the targets of confidentiality, availability and integrity.

For reasons of security the personal data shall be collected using an encrypted “Secure Socket Layer” (SSL-) connection (identifiable at the beginning of the internet address by the letters “https://” in the address bar of the internet browser).

Riverside uses so-called “cookies”, i.e. text files, or so-called “web beacons“, i.e. graphic files, which are stored upon the User’s display device. These are technologies with the help of which certain user-specific settings and technical information can be collected by means of which the User can be identified. This information reveals when and how Users use the Website and make it possible to continuously improve the latter. The use of cookies is standard procedure and the norm on many websites. Cookies are stored on the User’s display device, not on the Website.

Google's marketing services allow us to display advertisements for and on our website in a more targeted manner to show users only ads that potentially match their interests.
